TERMS AND CONDITIONS OF USE

  1. INTRODUCTION

Asia Assistance Network (M) Sdn Bhd (“Asia Assistance”, “us”, “we”, “our”) is bringing to you the AWAKEN, a digital solution that allows you to measure your health and wellbeing. AWAKEN consists of several tailored plan that carries various range of services including but not limited to health assessment, health coaching, reward program and other personalized health recommendations (“Services”).

Use of the AWAKEN (either through website of mobile app) including use of any products or services available in AWAKEN will be governed by these terms and conditions. By using the AWAKEN, products or services, the user acknowledges and agree to these terms. Consequently, you must carefully read the terms and conditions on AWAKEN, each time you intend to use it, as it may change without prior warning.

  1. ELIGIBILITY

AWAKEN is not intended or designed for a minor. By using the Services, you warrant that you have attained majority age of at least 18 years old and have reviewed, understood and consent to the terms and conditions.

By using the Services, you agree warrant that you are responsible for your own health conditions including to consult your physician before you participate in any of the programs under the Services including workouts, exercises or any other activities that are available through or enhanced by the Services.

 

  1. BINDING AGREEMENT

 

By accessing, using or downloading any of the Services, you unequivocally agree to follow the terms and conditions herein. You agree that the access, using, downloading or utilising any of the Services is made voluntarily and at your own discretion. If you do not agree with the terms and conditions, do not proceed and as a result you will not be able to use the Services.

  1. MODIFICATION

Asia Assistance reserves the right, at its own discretion to revise, amend, add or remove any portions of the terms and conditions at any time without prior notice to you.  You agree that by using the Services, you will periodically check the terms and conditions if there are any changes. If you continue using the Services after we made any changes or modification to the terms and conditions, it shall be deemed that you agree and accept of such changes.

  1. THIRD PARTY PRODUCTS AND SERVICES

We may appoint a third-party provider(s) or supplier(s) to perform the Services. However, Asia Assistance shall not be held accountable directly or indirectly for any information, contents, affirmations and expression contained in the third-party products or services. This liability shall at all times rest with the third-party provider(s) or supplier(s). Additional terms and conditions may apply to the products or services provided by the third-party provider(s) or supplier(s). We advise you to read, understand the terms and conditions before using, purchasing or using to such products or services.

  1. INDEMNITY AND RELEASE OF LIABILITY

To the fullest extent permitted by law, you agree to indemnify, hold harmless and releases Asia Assistance, its board of directors, officers, employees, agents, successors and assigns from any liability,  claims, losses, damages, liabilities and expenses arising out:

  • your use of the Services;
  • your activities carried out by using the Services e.g. physical workouts, health assessment;
  • your connection or communication to the Services;
  • your use of misuse of any personal data;
  • any violation of the rights of any person.

Under no circumstances, will Asia Assistance be liable to you for any special, indirect incidental, punitive damages, consequential or exemplary damages resulting from performance of the Services by the third-party provider(s) or supplier(s) attributable to bodily injury, sickness, disease, death, or to injury or destruction or damage to property, including the loss there from, or to any violation of any law or regulation, which arises out of or is any way connected with the performance of the Services or resulting from the negligence or wrongful acts of the third-party provider(s) or supplier(s) acting within their scope of duties to perform the Services and your use of the Services or inability to use any part or all of the Services.

You agree that this release of liability is a reasonable and fair allocation of risk between you and Asia Assistance and form an essential basis of the bargain between you and us as we will not be able to provide the Services without this release of liability. This release of liability survives termination of expiration of the terms and conditions herein.

  1. DATA PRIVACY

Any personal data provided by you will processed in accordance with our Data Privacy Policy. Please read carefully, understand and accept our Privacy Policy before you provide your personal data to us.

  1. REGISTRATION AND PASSWORD

Access to the Services provided through the AWAKEN require prior user registration, for which a password will be chosen to enable your personal identification. All assigned passwords will be personal and inalienable, and no assignment is permitted, not even provisionally, to third parties. Consequently, you undertake to diligently use the password assigned and to keep it secret and confidential at all times. Do not share your password with any third parties for any reasons.

  1. TYPES OF USE NOT PERMITTED

AWAKEN may contain features where you can post, publish, upload content or information (except personal data) such as your physical activity or workouts data, your diet or sleeping activity, opinions, allusions or contents whatsoever (“Content”). You agree that you are entirely responsible for all the Content that you share through the Services. You hereby undertake to use the Content and Services diligently, legally, adequately and lawfully. In particular, as a mere example without limitation, you undertake to refrain from:

 

  • using the Content and Services in a manner and for purposes that are contrary to law, morality and generally accepted good practices, or the public order;
  • using the Content and Services in such a way as to actually or potentially cause effects that are contrary to law, morality, generally accepted good practices or the public order;
  • transferring or disseminating information, data, messages, diagrams, drawings, sound and/or image files, photographs, recordings, software and, in general, any obscene, offensive or vulgar material, or which encourages criminal, denigrating, defamatory, dishonourable or violent conduct or, in general, which is contrary to law, morality, generally accepted good practices or the public order;
  • reproducing, copying or distributing the contents, or allowing public access thereto through any form of public communication, or transforming or changing them, unless the holder of the rights in question has authorised this, or this is permitted by law;
  • infringing any intellectual or industrial property rights belonging to Asia Assistance or third parties;
  • carrying out fraudulent transactions, or which could facilitate any illegal or fraudulent content whatsoever; and
  • using the contents and services and, in particular, any information whatsoever obtained through the AWAKEN digital platform (either website or mobile app) for any advertising purpose, to particularly include delivery of advertising, communications for direct sales or any other type of commercial purpose, unsolicited individualised messages or spam, or to otherwise distribute or divulge such information.

You will be fully responsible for adequately using the AWAKEN digital platform (either website or mobile app), pursuant to current law, further to the principles of good faith, morality and the public order. You must diligently follow any instruction provided to them, related to such use and access, as foreseen in these terms and conditions.

You shall be liable for any loss and damage whatsoever that Asia Assistance Network may directly or indirectly suffer as a consequence of breaching any of the obligations derived from these terms and conditions or the law, related to use of the AWAKEN digital platform (either website or mobile app).

  1. DISCLAIMER OF WARRANTIES AND LIABILITY

10.1  For contents provided through the AWAKEN platform (either website or mobile app)

If any of the contents, files, information, advertising, opinions, concepts and images hosted on the AWAKEN platform (either website or mobile app) were contrary to law, morality, good faith and the public order, or were to contain any type of malware or similar software routine, these will be immediately withdrawn. Asia Assistance hereby disclaims all liability for any contents, files, information, advertising, opinions, concepts and images that do not depend on the website or mobile app, or which are not under its management.

Asia Assistance will not be held directly or indirectly liable for misuse of the website or mobile app, contents included, by its user(s) and the person accessing or using the same will be fully liable.

 

10.2   For contents hosted on pages accessed from the AWAKEN platform (either website of mobile app)

Asia Assistance will not be liable for any of the contents, files, information, advertising, opinions, concepts and images that are issued, published or distributed, directly or indirectly, through any interconnected website, or which may be accessed through the website or mobile app, through links, or any services linked or related to such interconnected site. Likewise, Asia Assistance hereby waives all liability for any services, goods or products that may be purchased or hired from third parties through a website link, particularly if the purchasing or hiring process is directly executed on the third party’s website, and even if frames are displayed with web page branding.

10.3     For operation of the AWAKEN platform (website and mobile app)

Asia Assistance will provide its services and contents in a continuous manner, using any technical means within its reach in order to satisfactorily provide them. Asia Assistance, if deemed appropriate, may make corrections, improvements or changes on the AWAKEN platform (website or mobile app) including the information, in their Services or contents, without this entailing or granting entitlement to any claim or indemnification, or constituting an acknowledgement of any liability.

Asia Assistance hereby waives all liability for any loss and damage whatsoever that may arise from the availability and technical continuity of the AWAKEN platform operation (either website or mobile app) in events of beyond its control.

In any case, Asia Assistance will take all the necessary steps to restore its services after a technical failure.

Asia Assistance will not be liable for any misuse of your password to access the AWAKEN platform (either website or mobile app). Asia Assistance  reserves the right to interrupt your access to the AWAKEN platform (either website or mobile app), as well as the provision of any or all the contents provided through the same, at any time and without prior notice, for technical, security, control or maintenance reasons, if there is a power outage, or for any other founded cause.

10.4              For the Services provided through AWAKEN

10.4.1 Asia Assistance makes no warranty that:

  • the Services will meet your requirements and expectations.
  • the Services will be uninterrupted, timely or error-free;
  • the results derived from the use of the Services is accurate;
  • the quality of the Services, information or other content obtained by you by using the Services will meet your requirements and expectations.

 

10.4.2 You expressly agree that Asia Assistance is not providing any form of medical advice through the Services. You should consult your physician or other healthcare provider immediately if you have any health-related issues. Do not disregard or delay in seeking medical advice and rely on the content or information you obtained by using the Services.

 

 

 

  1. INTERACTIONS WITH THIRD-PARTY PROVIDER(S) OR SUPPLIER(S)

You acknowledge that some of the Services serve as an avenue for you to connect or communicate with third-party provider(s) or supplier(s) e.g. for health coaching or recommendations. Asia Assistance is a neutral facilitator and shall not directly or indirectly involved in the actual communications between you and the third-party provider(s) or supplier(s). We have no control whatsoever over the performance of the third-party provider(s) or supplier(s), the quality or services, legality, safety or any content made by the third-party provider(s) or supplier(s). You must at all times exercise your own due diligence and make good judgement when dealing with the third-party provider(s) or supplier(s).

  1. THIRD PARTY LINKS (INBOUND)

The AWAKEN platform (either website or mobile app) access service may include technical hyperlinks, directories and, even, search engines, allowing you to access internet websites (hereinafter, the “Linked Sites”). In these cases, Asia Assistance will only be liable for the contents and services provided on the Linked Sites insofar as it is effectively aware of their illegality or ability to harm third party goods or rights, and fails to deactivate the link with due care.

Asia Assistance is unaware of the contents and services of any Linked Sites and, consequently, will not be liable for any damage caused by the illegality, quality, outdating, unavailability, error or uselessness of the contents and/or services on the Linked Sites, or for any other damage not directly attributable to Asia Assistance.

If you decide to visit and/or use any of the Linked Sites, you will do so at your own risk, and must take the necessary protection measures against virus and other harmful components.

 

  1. LINKS TO THE WEBSITE (INBOUND)

Any internet user intending to introduce links from its own web pages to the AWAKEN platform (through its website) will follow the conditions described below; unawareness of the foregoing will not exclude it from legal liability:

  • A link may only be connected to the AWAKEN website home page, but may not reproduce it in any way (inline links, deep-links, browser or border environment, copy of texts, diagrams, etc.);
  • In accordance with applicable laws at all times, it will in any case be forbidden to establish frames of any kind surrounding the AWAKEN website, or allowing contents to be viewed through internet addresses other than the website and, in any case, if jointly viewed with contents outside the website, in such a way as to: (i) actually or potentially mislead or deceive users as to the actual source of the service or contents; (ii) constitute a comparison or unfair imitation; (iii) be used to take advantage of Asia Assistance brand awareness and prestige; or (iv) if otherwise forbidden by current laws;
  • The web page of the inbound link may not make any type of statement or indication that is false, inaccurate or incorrect, about Asia Assistance in general, or their employees, clients or quality of the services provided;
  • In no event will it be stated or suggested on the web page where the link is located that Asia Assistance has provided its consent to insertion of the link or that it otherwise sponsors, collaborate, verifies or supervises the sender’s services;
  • It will be forbidden to use any denominational, graphic or combined trademark, or any other distinctive sign of Asia Assistance, in the sender’s web page, except for the cases permitted by law or expressly authorised therein, and provided that a direct link is allowed to the Website, in the manner foreseen in this clause;
  • The web page establishing the link must accurately comply with the law and may in no case dispose of or provide a link to own or third-party contents which:

 

(i) are illegal, noxious or contrary to morality and good practices (pornographic, violent, racist, etc.);

  • Actually, or potentially induce users to mistakenly believe that Asia Assistance Network are subscribing, endorsing, adhering to or otherwise supporting the sender’s ideas, statements or expressions, whether legal or illegal;
  • are inappropriate or not pertinent to Asia Assistance activity, given the place, contents and theme of the sender’s web page; and
  • establishing any such link will in no case mean that relations exist between Asia Assistance and the owner of the web page in question, or Asia Assistance Network acceptance or approval of the contents or services offered therein and made available to the public.

 

  1. INTELLECTUAL PROPERTY

It will be forbidden for you to reproduce, distribute, publicly communicate or transform all or part of the contents (images, texts, designs, indexes, shapes, etc.) making up AWAKEN platform (either website or mobile app), to generally include any exploitation act, as well as the databases and software required for its viewing or operation.

All contents, without exception and limitation, making up this website or mobile App, i.e. information, photos and videos, articles, data, texts, logos, icons, pictures, design and image (external appearance or “look & feel”), video and audio files, databases, computer applications, are owned by Asia Assistance or are exploited under third party licences, holding any intellectual and/or industrial property rights over such contents.

 

  1. SUBSCRIPTION FEE

 

There will be subscription fee for you to use the Services in accordance with the plan that you subscribed. You agree to pay the subscription fee due and incurred by your use of any of the Services. We will set up, arrange and administer the payment mechanism and you agree to follow the payment term and mechanism accordingly. We reserve the right to terminate your access and use of the Services for any non-payment of the subscription fees and or associated charges (if applicable). You agree that under no circumstances we will refund you any part of the subscription fee paid by you if you decide to terminate or not using the Services anymore.

 

  1. GOVERNING LAW

 

The terms and conditions hereof and any matter relating to the use of the Services shall be governed and construed in accordance with the laws of Malaysia. The parties agree and submit to the exclusive jurisdiction of the Courts of Malaysia.

 

REALISE HEALTH SDN BHD TERMS OF SERVICES 2021

  1. INTRODUCTION
    • This website (“Site”) is owned and operated by Realise Health Sdn Bhd (Company No. 201901046372) (“Realise Health” “Realise Health Group” “LiveSmart” or “We”/ “Us”/ “our”/ “ours”). Please read the following important terms and conditions carefully. By accessing the Site, you acknowledge that you have read, understood and agreed to be bound by this Terms of Services (as amended from time to time). The Privacy Notice will supplement and form an integral part of these Terms of Services.

 

  • You may accept the Terms of Services and the Privacy Notice by clicking “I accept” or “I agree” where it is made available to you in the user interface of this Site. Upon acceptance, the Terms of Services shall constitute a legal and binding between yourself and Realise Health. You may not use the services or the features of the Site if you do not accept the Terms of Services or are unable to be bound by the Terms of Services.

 

  • You acknowledge and agree that Realise Health may, at its sole discretion, without liability and without prior notice, update, supplement and/or amend this Terms of Services, and that any such update, supplemental or amendment shall form part of this Term of Services. We will notify such changes by updating the Terms of Services and modifying the last revised date displayed on this page. Your continued use of the Site and/or the services following any such revision shall constitute your agreement to be continuously bound by the amended Terms of Services.

 

  • In addition to these Terms of Services, any products and/or services made available through the Site may be subject to additional terms and conditions or guidelines which may be communicated by us from time to time. These additional terms and conditions or guidelines in respect of such products and/or services will supplement and form an integral part of this Terms of Services unless stipulated otherwise.

 

  1. Registration
    • There is no requirement to register an account with Realise Health. Should you choose not to register an account with us, you will only be able to access our Site for browsing purposes only. To enjoy our interactive features or to purchase our products and/or services, you will need to register to become a User. Registration is non-transferable.

 

  • To register for an account, you will be required to place an order, complete an online form and accept our Terms of Services and Privacy Notice. Upon registration you will receive an email confirming your order and your collection method. This email will also prompt you to login to your online account, complete your health profile and create your password for security purposes.

 

  • As part of the registration process, you will need to provide us with certain information in order to enable us to create your account. By creating an account, you agree to ensure that your registration details are true and accurate at all times. An account created with false information is a breach of this Agreement. Any information provided will be used and protected in accordance with our Privacy Notice.

 

  • As a User, your account is personal to you. You are responsible for safeguarding your User ID and password at all times, an be responsible for all activities that occur under your account. You acknowledge that we bear no responsibility regarding any extraction or derivation of information from your account (and/or our Site or Services) conducted by you, and that you remain responsible at all times for the use of such information.

 

  • If you purchase our services directly from us, [and by selecting and proceeding with the payment option made available on the Site], you are deemed to have authorised us to charge you for your purchase of the services offered based on pricing package as displayed on our Site and any applicable tax as may be imposed by the Government of Malaysia from time to time. This payment method shall not apply to corporate packages made by your organisation for its employees’ behalf.

 

  • Corporate packages for organisations are subject to the agreed terms and conditions under their respective commercial contract with us. However, the provisions of this Terms of Service shall be applicable to you as user of the Site, unless stated otherwise.

 

  • In the event of an unauthorized use of your account or a suspected security breach, you may contact our customer services at info@realise.my. We shall not be responsible for your losses caused by unauthorized use or security breach of your account.

 

  • You may close your account at any time by following the instructions displayed on the Site. Additional provisions relating to account closure are set out in Paragraph 11 below.

 

  1. Services

The Realise Health Services are provided for Users based in Malaysia. As a User, you will be able sign up for the Realise Health Services as follows:

 

    • Health Dashboard

The Health Dashboard allows you to engage with our online services and undertake Health Assessment(s) based on the health details you have provided. The results of the health assessment will be displayed on the Health Dashboard, along with the guidance provided by doctors we work with. In the event the Health Assessment indicates that further investigation is required, you will be guided to your practitioner or existing healthcare provider to seek further assistance.

 

  • Health Assessment

Our Realise Health Assessment includes an online health survey and pathological services. The aim of our Health Assessment is to allow Users to be proactive about their health by identifying potential health risks. We anticipate for the results of the Health Assessment to be made available within 5-10 working days from the date the laboratory receives the relevant testing sample, following which you will receive an e-mail notification and update Health Dashboard. Please note that our Health Assessment is not meant to be taken as diagnostic tool, and is not mean to replace your existing healthcare provider(s), but act as a supplement to them.

 

  • Collection of Pathology Samples

Our pathology services are conducted by external third parties whom we have partnered with. Your pathology samples will be collected in accordance with the methods prescribed by us. Please note that we do not accept responsibility for the collection, transportation and analysis of your pathology samples, as such services are conducted by our appointed third parties. For more information, please refer to the disclaimers in Clause 6.4 below.

 

  • Health Coaching

Health Coaching is a process that facilitates healthy, sustainable behavioural change, and is provided by our registered Dietitians as part of our Health Improvement Programmes. Our Dietitian will provide advice and guidance provided aligned with current research and medical knowledge, with the aim of facilitating healthy and sustainable behaviour in Users.

 

  1. Cancelation for Health Assessments
    • Our fees are generally non-refundable unless we specifically communicate otherwise at the time of purchase. Unless communicated otherwise, you may not cancel the Health Assessment after we have generated your Health Assessment results and made informed you of the same via the via your updated Health Dashboard.

 

  • You may cancel your order by writing to us at info@realise.my within 14 days from the commissioning of the Health Assessment. If you have purchased the Realise Health Services from us directly, your payment will be refunded provided:

 

  • Your cancelation request is made after you have submitted your pathology samples, but before we have received the results of such samples from the testing laboratory. In the event of such cancellation, we will refund you with 50% of the charges, which shall be paid within 14 days from the receipt of your cancelation request; or
  • Your cancelation request is made before you have submitted your pathology samples. In the event of such cancellation, we will refund you with 85% of the charges, which shall be paid within 14 days from the receipt of your cancelation request.

 

  1. Representation and Warranties
    • By using the Site, you represent, warrant and undertake that:
      • you have the right, authority and capacity to accept and abide by the terms and conditions under this Agreement;
      • you are at least 18 years of age;
      • you have provided true, current and complete information in your dealings with us (including when setting up an account), and will promptly update any information as required so that the information remains true, current and complete; and
      • your use of the Site will not violate any laws or regulations applicable to you;

 

  • By requesting for a Health Assessment, you further represent, warrant and undertake that:
    • you have completed an accurate request form identifying the pathology sample(s) as one taken from yourself;
    • you are aware of the potential impacts and risks of pathology sample taking and analysis, and that you are proceeding on the basis that you accept full responsibility for any outcomes or consequences that may arise from these; and
    • your request for a Health Assessment will not violate any laws or regulations applicable to you.

 

  1. Disclaimers
    • Although we take reasonable efforts to ensure that any information, including test results obtained and displayed by us within your Account dashboard are correct, we do not accept responsibility as to the reliability, timeliness, availability, quality, accuracy or completeness of in connection with your use of this Site.

 

  • You acknowledge that the information provided under the Realise Health Services are for information and recommendation purposes only as guidance in your journey to achieving a healthy lifestyle.

 

  • Any health scores and pathology screening obtained through You further acknowledge that our services are derived from screening analysis, which should not be construed a substitute for diagnostic or clinical advice. You should seek assistance from certified if you have any concerns with regards to any or upon receiving the health scores and pathology screening results actual medical advice

 

  • To the extent permitted by law, we have no liability or responsibility to you or any other person for any loss in connection with:

 

  • Any action or inaction on your part subsequent to the health profile and health and wellness related information generated through the Site in connection with the Realise Health Services;
  • Additional cost relating to procurement of substitute tests as may be required under the Realise Health Services (i.e. the cost of replacement test);
  • Events, delays, and failures beyond our control encountered by our third-party service providers, who assist with the collection, transportation and analysis of your pathological samples;
  • The Site being unavailable (in whole or in part) or performing slowly;
  • Any error in, or omission from, any information made available through the Site;
  • Any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the Site. For the avoidance of doubt, you are responsible for ensuring that the process by which you access and use the website protects you from this; and
  • Any site linked from the Site. Any link on the Site to other websites do not imply any endorsement, approval or recommendation of, or responsibility for, those sites or their contents, operations, products or services referred to or contained on those linked websites, unless and to the extent stipulated to the contrary.

 

  1. Intellectual Property Rights

 

  • Intellectual Property Rights” shall mean all present and future rights conferred by statute, common law or equity (and all moral rights) in or in relation to any business names, computer software, confidential information, copyright, designs, domain names, inventions, know-how, patents, logos, trademarks, the benefit of any application to register such a right and the benefit of any renewal or extension of such a right.

 

  • We reserve all of our Intellectual Property Rights in our Site. We retain the ownership of any Intellectual Property Rights developed by us, and the licenses of any Intellectual Property Rights granted by our licensor of affiliates, as the case may be. Using our Site does not give you ownership of any content or Intellectual Property Rights made available on through our Site.

 

  • Notwithstanding Clause 7.2 above, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Site and its features (including its software, cloud and network-based features) for your personal, non-commercial use for lawful purposes.

  1. Limitation of Liability
    • To the extent permitted under Malaysian law, we give no representations and warranties, whether express or implied, of any kind including any implied terms of satisfactory quality or fitness for a particular purpose.

 

  • We do not warrant that the features and functions of the Site will be uninterrupted, or that the Site or Realise Health Services are free from error, defect, virus or other elements. We will not be held liable for any disruption, interference, outage or non-transmission, loss of content, damage to your device caused by any bugs, virus or the like which may be transmitted through the use of the Site or the Realise Health Services.

 

  • You agree that we shall not be liable for any loss or damage incurred by you which is cause by or in connection with the use of our Site or the Realise Health Services. You further agree to indemnify and hold us harmless against any claims, demands, loss and damages, costs and liability which we may suffer in connection with or arising from your negligence, infringement or breach of this Terms of Services during your access or use of the Site or the Realise Health Services.

 

  • The indemnity herein shall survive the termination or expiry of this Agreement.

 

  1. Force Majeure

We are not responsible for failures or delays in performance resulting from force majeure events which include the acts of God, strikes, lockouts, riots, acts of war, epidemics and pandemics, governmental regulations imposed after the fact, fire, communication line failures, power failures and outage, earthquakes or other disasters.

 

  1. Termination
    • Right to Terminate

You are free to terminate this Agreement at any time by deleting your account.

 

We reserve the right to terminate this Agreement and delete your account in the event we discover there has been a breach of this Agreement or other additional terms and conditions agreed between us. We will give you prior notice of such termination/deletion, although we may delete your account without notice if we reasonably believe that your use of our Site could in any way interfere, compromise or damage the Site or may otherwise compromise, damage or interfere with the Site. Additionally, we reserve the right to suspend, discontinue or terminate the operations of the Site by giving reasonable notice to the User.

 

  • Effect of Termination

Upon the termination of this Agreement, your right to use the Site is automatically revoked, and your account will be closed. We shall immediately be relieved from all further obligations under this Agreement. Any information you have submitted to us will be handled in accordance with the terms of our Privacy Notice.

 

Any fees you have paid for shall not be refunded unless we had specifically communicated otherwise prior to the termination of this Agreement.

 

  1. Waiver

Any waiver or indulgence granted shall not prevent us from enforcing our rights under the Terms of Service which are unaffected by such waiver or indulgence. The rights and remedies provided by operation of the laws are not excluded by the Terms of Service. In the event of delay to exercise or enforce any right under this Terms of Service will not operate as a waiver of such right by us.

 

  1. Governing Law

This Agreement shall be construed and governed in accordance with the laws of Malaysia. You agree to submit to the exclusive jurisdiction of the courts of Malaysia.

 

  1. Severability

If any of the provisions, terms or conditions are found to be prohibited or illegal, they shall be ineffective only as to the illegal or prohibited parts of such provisions, terms or conditions, and the remaining provisions, terms or conditions shall be unaffected.

In the event a dispute cannot be resolved through our internal procedure, we will reach out to you to inform you of such non-settlement and provide you with relevant information in respect of the Tribunal for Consumer Claims (as required by law)
